Case P&Z 2008-14

Focus Retail, LLC — Walgreen’s application to put some parking out front of their proposed location at Cruz Alta and Paseo Del Pueblo Sur (lengthy debate by the Commission)

Variance request to locate 10 parking spaces in front of a commercial building.

Results

The commission approved the requested variance.

Town of Taos – first official application of the SmartCode

Zone Change and Amendment to the Town of Taos Land Use Development Requests

Town of Taos Chamisa Verde Affordable Housing Subdivision

Results

1) The Commission scheduled these requests for a special meeting to be held 5:30 p.m., September 17, 2008 – no other items to be on this agenda.

2) Staff was directed to work with concerned citizens on the proposed zone

change to Chamisa Verde Affordable Housing Subdivision.

3) Staff is going to work on minor corrections to the proposed maps that were

submitted to the Commission.

Case P&Z 2008-20

Andrew & Joetta Arguello – two room structure built without permits; without approved setbacks

Appeal of a decision made by the Code Administrator to deny an appeal which was submitted after the 10 working day period allowed under section 3-8.4 of the Town of Taos Land Use Development Code for decisions made by the Planning and Zoning

Commission.

Results

The Commission denied the applicant’s request to overturn the decision made by the

Code Administrator.

Ron Urban – Ronnie Lee’s Super Club and Grill; application to add second story addition to south side of restaurant

Case P&Z 2008-21

Elaine Levy – residential 8 ft by 8 ft bathroom addition

Certificate of Appropriateness Request

519 Camino De La Placita

Results

Commission scheduled this Certificate of Appropriateness

Request with the following conditions:

1) This request was scheduled for a final public hearing for the September 3, 2008

P&Z Commission meeting.

2) The applicant must submit more detailed elevations on the proposed

changes to the subject building.

3) Staff is directed to do research on the subject building to determine

whether or not it is a contributing building within the Historic Overlay

Zone.

4) The applicant needs to submit a more detailed site plan for the commission

to consider.

5) The applicant needs to revise some of the submitted  floor plans to make them consistent with the requested Certificate of Appropriateness.

6) The applicant either needs to submit an application for a Variance Request for

side yard setbacks or work with staff to revise the proposed setbacks to comply

with the requirements of an R-14 Multi-Family Residential Zone.

Case P&Z 2008-22

Steve Gomez – comprehensive renovation of a residence

Results

1)   This request was scheduled for a final public hearing for the September 3, 2008

P&Z Commission meeting.

2) Applicant needs to submit elevations of the subject building showing existing

facades and proposed facades.

3) Staff is directed to do research on the subject building to determine

whether or not it is a “contributing building” within the Historic Overlay               Zone.

4) Staff needs to include the Certificate of Appropriateness Request Application, previously submitted, in the packet for the commission to review for next month’s final public hearing.

5) Applicant needs to submit door and window schedules for commission review.

6) Applicant needs to submit details on bull-nosing for the proposed windows.

7) The commission wants details on the height of the parapets.

Case P&Z 2008-17

Charles M. Simmons – Parr House; currently gallery near Lady of Guadalupe, same side of street; converting car port to office space

Results

The commission approved the applicant’s request with the following

Conditions:

1) The applicant submit a stucco sample for the proposed remodel and new construction on the subject building at the time a building permit application is applied for with the Town of Taos Planning and Zoning Department.

2) The applicant submit color samples for the proposed doors, columns, and corbeles at the time a building permit application is applied for with the Town of Taos Planning and Zoning Department.

3) The applicant submit a door and window schedule with his building permit application so that the town’s building officials are aware of the approved window and door styles.

4) Any significant deviations from the architectural plans that are approved by the P&Z Commission shall need to be reviewed by the Planning and Zoning

Department and/or the Planning and Zoning Commission.

Case P&Z 2008-11

Diamond Plaza, LLC – location across from Holy Cross Hospital

Conditional Use Permit Request to locate studio apartments in a C-1 Neighborhood

Commercial Zone.

Results

The commission approved the applicant’s request with the following conditions:

1) A Drainage Plan prepared by a Civil Engineer licensed in the State of New Mexico which ensures that the proposed drainage structure on the subject property can handle the drainage from the new proposed mixed use building and the  existing professional office which is immediately adjacent to the east of the applicant’s property.

2) A notarized legal agreement between the applicant and the owner of the professional office building for maintenance of the mutual drainage structure be submitted to the Town of Taos Planning and Zoning Department.

3) An STA Level Traffic study be prepared by an engineer licensed in the State of New Mexico. This report is then to be submitted to the Town of Taos Planning and Zoning Department.
